By accessing the Lend1 broker CRM and client management platform ("Lend1"), operated by Lend1 Pty Ltd, you agree to these Terms & Conditions, all applicable laws, and any relevant local regulations. If you do not agree, you must not use or access this site or service. These Terms & Conditions work together with our Privacy Policy and Cookie Policy.
Disclaimer
Materials on the Lend1 website and platform are provided "as is." Lend1 disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property. Lend1 makes no representations regarding the accuracy, reliability, or likely results of using these materials.
Limitations
In no event shall Lend1 or its suppliers be liable for damages (including loss of data, profit, or business interruption) arising from use, or inability to use, the platform or website materials, even if advised of such possibilities. Some jurisdictions do not allow certain liability limitations, so these may not apply to you.
Accuracy of Materials
The materials on our website and within the platform may include technical, typographical, or photographic errors. Lend1 does not warrant that any materials are accurate, complete, or current, and may change or update them at any time without notice. We do not commit to updating these materials.
Links
Lend1 has not reviewed all sites linked to its website and is not responsible for their contents. The inclusion of any link does not imply endorsement. Use of any linked website is at the user's own risk.
Cost of Service & Recurring Charges
You will be shown all subscription plan details, including costs and payment methods, during registration or plan changes. You can manage or cancel your plan at any time from your admin panel.
Authorisation
You authorise Lend1 to instruct the financial institution that issued your card to charge your card account under these Terms.
Service Fees & Billing Cycle
Lend1 service is billed monthly on your subscription anniversary date unless you choose an annual plan, in which case you will be billed annually on your anniversary date.
Add-ons
Additional features may incur extra costs. You will be notified of any charges and asked to confirm before adding them.
Delinquency
If payment fails and your account becomes past due, your account may be suspended immediately. A suspended account means your team will not be able to log in to Lend1, manage deals, or onboard new clients until payment is resolved.
Refunds
No refunds are provided for subscription fees already charged. If you wish to avoid further billing, cancel before your next billing date.
Cancellations
Cancellations require 30 days' notice. Cancel from your admin panel to stop further billing.
Affiliation
Lend1 is not affiliated with the brokerages using our platform. Brokers, not Lend1, are responsible for providing credit advice, financial services, and submissions to lenders, and for complying with their obligations under the National Consumer Credit Protection Act 2009 (Cth) and any applicable Australian Credit Licence or representative authorisation.
Misconduct
We reserve the right to suspend users for inappropriate platform use, with written notice. Brokers must hold a valid Australian Credit Licence or be authorised as a credit representative under another licensee, and must own or hold the rights to all materials uploaded to the platform. Copyright infringement is prohibited. Brokers must conduct themselves honestly, comply with responsible lending obligations, and treat their clients fairly.
Liability
Lend1 is not liable for damages, losses, or downtime. We strive for 99.9% uptime but cannot guarantee uninterrupted service due to potential external or unforeseen issues. Please report any issues so we can resolve them.
Rights, Ownership & Data
Data processed by Lend1 is stored according to our Privacy Policy. We may analyse anonymised data and hold full rights to data processed on our servers on behalf of brokers. Brokers retain rights to their own client and deal data and are responsible for its accuracy, lawful collection, and for obtaining any consents required to process that data through Lend1.
We reserve the right to publish non-personally identifiable testimonials and broker stories. Brokers can request the removal of such content as outlined in our policies.
Compliance
Users must comply with all relevant laws, including the National Consumer Credit Protection Act 2009 (Cth), the Privacy Act 1988 (Cth), and GDPR if applicable. Lend1 assists brokers by maintaining its own compliance and providing tools to support data subject requests. Brokers must fulfil data requests from their clients (and from EU customers where GDPR applies) and notify Lend1 when needed.
Modifications
Lend1 may update or revise these Terms & Conditions at any time without notice. Continued use of our website or platform after such changes indicates your acceptance.
Governing Law
These Terms & Conditions are governed by the laws of South Australia. You irrevocably submit to the exclusive jurisdiction of the courts of South Australia.
